1. Status of these terms

These are the written terms required by Regulation 14 of the Conduct of Employment Agencies and Employment Businesses Regulations 2003. They govern the relationship between you (the work-seeker) and Brian Gillingham trading as ProperFit Hire (the employment agency) in respect of work-finding services.

You should be given a copy of these terms before the agency provides any work-finding service to you. If you have not received them, ask for them at dpo@properfithire.co.uk.

2. Type of agency we are

ProperFit Hire is an Employment Agency as defined in section 13(2) of the Employment Agencies Act 1973. We introduce work-seekers to employers (hirers) for the purpose of permanent or fixed-term direct employment with the hirer. We are not an Employment Business — we do not employ you ourselves and we do not supply you to a hirer to work under the hirer's supervision while remaining your employer.

3. Fees

You will not pay any fee to ProperFit Hire for finding you work. This is a statutory requirement under Regulation 5 of the Conduct Regs and applies to all work-seekers regardless of role or salary.

The hirer (employer) pays our fee. Our fee structure is transparent and available at https://properfithire.co.uk/pricing — but it is not your concern and never affects your candidacy or our recommendation.

4. Service we provide to you

When a hirer uploads your CV (typically because you applied to a role they are recruiting for), ProperFit Hire will:

1. Score your CV against the role using the deterministic Mermoid engine

2. Provide the hirer with a written, citation-backed report ranking you alongside other applicants

3. Make our methodology and citations available to you on request

4. Honour all your UK GDPR rights (see Candidate Privacy Notice at https://properfithire.co.uk/privacy/candidate)

5. Information we hold about you

The information we hold is what you put in your CV when you applied to the hirer. We do not enrich it from third-party sources. Full details: Candidate Privacy Notice.

6. What we will tell you about each opportunity

If a hirer wishes to progress you for a role we have scored you for, we will provide the following at the earliest opportunity (Reg 18):

We will not introduce you to a role for which you are not legally qualified or which we know to be unsafe.

7. Right-to-Work checks

If you are introduced to a hirer who progresses to interview, the hirer (not us) is responsible for verifying your right to work in the UK under the Immigration, Asylum and Nationality Act 2006 — a statutory excuse against illegal-working civil penalties.

If your CV indicates you require sponsorship, we will route you specifically to hirers who hold a sponsor licence; we do not exclude you from consideration on this basis.

You can withdraw from a recruitment process at any time. Tell the hirer (and copy us at dpo@properfithire.co.uk if you wish). We will:

10. Complaints

If you are dissatisfied with how ProperFit Hire has provided the work-finding service, please email dpo@properfithire.co.uk. We will acknowledge within 5 working days and respond in full within 14 working days. You may also escalate to:

11. Variation

We may update these terms. The latest version is published at https://properfithire.co.uk/terms/work-seeker. Material changes affecting your rights will not be applied retrospectively.

12. Governing law

These terms are governed by the laws of England and Wales. Any dispute will be heard in the County Court at Lincoln.

13. Statutory acknowledgement (Reg 14(3))

The following statement is required by Regulation 14(3):

> *ProperFit Hire is an employment agency operating under the Conduct of Employment Agencies and Employment Businesses Regulations 2003. The agency does not require you to use additional services for which a fee is payable.*
